LMIA Restrictions

There is some constraint regarding giving work permits under LMIA.

Some of the constraints are because of territorial, commercial, or employment conditions and some are because of the candidate’s lack of qualifications to become eligible.

Employment, industrial or regional constraints:

There are some job types that cannot be LMIA approved depending on the industrial and regional regulations.

• If any post has been LMIA rejected within the previous 24 months, the post will not be qualified for LMIA at present.
• In Alberta, some specific posts under high or low wages are considered ineligible for LMIA. Those posts are supervisor, civil engineer, plumber, carpenters, manager for engineering, financial brokerage, insurance advertisement, marketing & public relation, etc.
• If the job offer of a domestic caretaker states that the person hired will have to reside in the employer’s house, the LMIA application will most possibly be rejected.

• If a territory of Canada has 6 jobless people out of every 100 residents, jobs with low pay under the retail trade section or accommodation & food section will not be eligible for LMIA.

• If a low-wage job post exceeds the 10% cap rate of non-permanent international laborers who can be hired at a low pay at a particular job place, the LMIA will be rejected. Based on different situations there can be exceptions

Unqualified workers:

There are a few kinds of workers who are not qualified to be a candidate under LMIA. Those are stated below.

• Workers who are expelled from the program of the non-permanent international workers.
• Workers charged with a fine but failed to pay the money.
• People who work at sexual or pornographic sectors.
